Wen Shan graduated from the University of Leicester in 2012 and was called to the Bar of England and Wales in October 2013. After walking the Camino de Santiago, he commenced his pupillage in Skrine and was admitted to practice as an Advocate and Solicitor of the High Court of Malaya on Good Friday of 2015. He practices general litigation, with a focus on insurance and reinsurance disputes.

He has appeared as counsel in the Sessions and High Court in hearings, and has assisted in Court of Appeal hearings.

He has a keen interest in the outdoors, enjoying long distance hiking on the long holidays, participating in triathlons on the short ones, and climbing on the weekends.

Insurance and Reinsurance

  • Advised a reinsurance company on the legal and factual merits of a dispute in a claim against 2 European retrocessionaires for a quota share treaty contract worth USD 7 million and RM 1 million.
  • Advised, acted, and negotiated for a reinsurance company in defending an arbitration claim filed by an ASEAN based insurer against it for a value of RM 6 million which resulted in very favourable settlement terms for a significantly lower sum.
  • Acted as co-counsel in defending a reinsurance company and advised on negotiating a settlement for a dispute involving over 100 reinsurance claims worth about RM18 million.
  • Acted as co-counsel in defending a reinsurance company in a dispute involving over 200 insurance claims valued at RM20.5 million
  • Advised on the duty of an insured company and the duty owed by an insurance broker to an insured in the event of a failure to advise on the possibility of non-coverage of insurance; advised and assisted in helping the client file an official complaint against an insurance company to Bank Negara Malaysia as the regulator.
  • Advised a reinsurance company on its strategic position with regard to a claim against it by a Middle Eastern insurer.
  • Assisted as a pupil in the Court of Appeal’s landmark decision of Best Re (L) Limited v Ace Jerneh Insurance Berhad (formerly known as Jerneh Insurance Bhd) [2015] 5 MLJ 513. The Court of Appeal held that a mere general reference to the original contract constituted effective incorporation of an arbitration clause into a reinsurance contract.

Medical Negligence

  • Acted as counsel in defending a specialist doctor in a medical negligence matter. Successfully submitted that no fair trial could be had without essential documents in the Plaintiff’s possession. The Court dismissed the suit against the specialist with costs.



  • Co-Authored “Incorporation by Reference – Best Re (L) Ltd v ACE Jerneh Insurance Bhd” [2015] 5 MLJ 513 – SKRINE Legal Insights Issue 3/2015 in September 2015.
