  Overview  

Janice Tay is a graduate from the University of Cambridge and was called to the English Bar (Lincoln’s Inn). Upon returning to Malaysia, she commenced her pupillage in the Construction and Engineering Department at Skrine and was admitted as an Advocate and Solicitor of the High Court of Malaya.

She is currently a Partner in Skrine, an Adjudicator in the panel of the Kuala Lumpur Regional Centre for Arbitration, and Arbitrator and a Mediator.

Janice is the current Deputy President of the Society of Construction Law, Secretary of the Chartered Institute of Arbitrators (Malaysia), Committee Member of the Chartered Institute of Arbitrators (Malaysia) Young Practice Group), Drafting Committee Member of Malaysia’s First Supplement to the Delay & Disruption Protocol published by the Society of Construction Law (Malaysia) and Committee Member of the Migrants, Refugees & Immigration Affairs Committee of the Malaysian Bar.

  Experience  

  • Experienced in dealing with issues pertaining to the design, procurement and construction of a semi-submersible floating production system with additional related support services. Advised on possible dispute resolution forums, claims, allegations of defects and delay.
  • Advised an off-shore company in relation to an 'Engineering, Procurement, Construction and Commissioning of Pumping Facilities Contract' in relation to the building, constructing and commissioning a one thousand kilometer pipeline and pumping facilities for the passage of crude oil. Engaging in conflict of laws issues (jurisdictional and appropriate forums).
  • Dealt with arguments pertaining to engineering service for the supply of process topsides systems and engineering services for Offshore work. Advised on, amongst others, warranties, condition precedents and claims pertaining to procurement retention sum, engineering deliverables, acceleration costs, backcharges.
  • Advised on Basement Construction Works for the Proposed Mixed Development in relation to delay analysis, defects, rectification works.
  • Advised Korean counterparties as regards the Malaysian standard forms of Contract and claims, such as those relating to Liquidated Ascertained Damages.
  • Experienced in foreign and local arbitrations using the ICC, PAM, KLRCA, IEM rules of arbitration.
  • Experienced in construction issues such as injunctions on bank guarantees/ performance bond claims, retention sum claims, delay analysis and quality issues, termination.
  • Adjudicator for several disputes involving construction contracts pertaining to retention sums, variation claims, loss and expense, defective claims and delay damages
