  Overview  

Jocelyn graduated from the University of Northumbria in 2006 and was called to the English bar (Lincoln’s Inn) the following year. She obtained her Master of Laws from the same university in year 2008. Upon returning to Malaysia, she commenced her pupillage and was admitted as an Advocate and Solicitor of the High Court of Malaya in 2009. She was made a Partner in Skrine in January 2017.

Jocelyn’s areas of practice encompass both front-end project advisory work and acting in contentious disputes. She has been involved in drafting, reviewing, negotiating and advising on all the major standard forms of construction and consultancy contract, including FIDIC, PAM, JKR or Public Works Department (PWD), CIDB, IEM and BEM forms, and on a wide range of bespoke contracts. In contentious matters, she has acted for developers and contractors at various stages of dispute resolution.

Cement Plant Project

  • Advised a subsidiary company of a leading multinational lime production company headquartered in Belgium in the EPCM contract relating to a stone preparation plant and stone calcination plant in Tapah, Perak (Malaysia).

Commercial Projects / Residential Projects / Government Related Projects

  • Acted for a key piling company in Malaysia in its successful appeal to the Court of Appeal in claiming damages for more than RM4million under a subcontract relating to a government building project [2013] 4 MLJ 37.
  • Acted for a sports facilities construction company against a turnkey contractor in the High Court in claiming for outstanding subcontract sum and retention sum arising under a subcontract relating to a government sports complex project.
  • Acting for a sport facilities construction company against a ready mixed concrete supplier in claiming for damages arising from the supply of ready mixed concrete relating to a government school project.
  • Acted for a public listed property development company in the High Court in resisting a claim by a joint management body of a commercial building.
  • Acted for an individual against a developer in the High Court in claiming for outstanding LAD and guaranteed rentals arising under sales and purchase and tenancy agreements.
  • Acted for a public listed property development company in the High Court in its urgent application for an injunction order and successful application for interim injunction order restraining a subsidiary company of Malaysia’s premier trustee company from, inter alia, filing, serving and/or proceeding with the statutory winding-up notice pursuant to section 218 of the Companies Act 1965.

Industrial and Healthcare Facilities

  • Advised an international pharmaceutical company on the legal issues and project structuring pertaining to the construction and development of a customized bio-technology research and manufacturing facility in Nusajaya, Malaysia.
  • Advised an international bio-chemical company on the construction and development of a bio-refinery production facility in Johor, Malaysia as well as drafted, reviewed and attended negotiation of an EPCC contract and its related documents.
  • Drafted, reviewed and advised upon the terms of an EPCM contract pertaining to the expansion of the production site of a monomer recovery plant in Pasir Gudang, Johor.

Infrastructure and Transport

  • Providing on-going advice to the works contractor, a leading master builder and construction company in Malaysia, on the construction and completion of the works relating to the Klang Valley mass rapid transit project.
  • Advised the consortium, which includes a leading multinational infrastructure company headquartered in the UK, on its bid for the engineering, procurement, construction, testing and commissioning contract for the performance of track works relating to the Klang Valley mass rapid transit project.
  • Advised Spain’s leading information technology company on the design, construction, testing and commissioning contract for the performance of the civil works relating to the integrated control centre of the light rail transit and monorail lines of Kuala Lumpur project.
  • Advising a Malaysian airport company on various construction issues and professional liability issues on the project in relation to Malaysia’s new terminal at KL International Airport.
  • Advising a leading global service provider of public transportation solutions on the for the KL Monorail Fleet Expansion Project.

Power Plant / Energy Related Matters

  • Acted for the independent power producer in its urgent application for an injunction order and successful application for interim injunction order restraining the owner of the electricity generating facilities from demanding under a bank guarantee issued pursuant to a power purchase agreement.
  • Advised Spain’s engineering and construction company on its bid for the design, engineering, procurement, construction, testing and commissioning contract relating to a cogeneration power plant in Pengerang, Johor.
  • Advised Japan’s leading global engineering company in LNG, petroleum and petrochemical industries on the enforceability of dispute resolution clause involving arbitration and its legal rights under an EPCC contract for a world class integrated refinery and petrochemical complex at Pengerang, Johor.

Other Experience

  • General advisory work on a broad spectrum of construction, engineering and infrastructure legal issues including tender, project documentation, statutory registration requirements.
  • Advising on and drafting of contracts in construction and its related areas including consultancy services contracts.
