  Overview  

Charmayne Ong was admitted as a partner of Skrine in 1996. She is a registered Patent Agent, Design Agent and Trade Mark Agent in Malaysia. She is the Head of Intellectual Property division of Skrine and is in charge of both the trademarks registration practice group as well as the IT and E-Commerce practice group.

Charmayne’s areas of practice include managing the registration of trademarks and general advisory work relating to the classic forms of IP rights: trade mark, copyright, industrial design rights and patents. Her experience involves advising on and drafting of contracts in intellectual property (e.g. licensing, franchising, distributorships, contract manufacturing and technology transfers). She is also familiar with IT and E-Commerce matters, having been involved in matters relating to e-commerce, Internet banking, Cyberlaws, communications and multimedia.

Charmayne was named as one of AsiaLaw’s Leading Lawyers since 2009 for Intellectual Property. She has been listed as a leading individual in Asia Pacific Legal 500 for IT and Telecommunications in since 2008 and also listed as a leading individual in Intellectual Property for Chambers Asia since 2009. She is recognised by Who’s Who Legal 2014, 2016 and 2017 as one of the best legal practitioners in Malaysia in the field of Information Technology and Technology, Media and Telecommunications (TMT).   Experience  

  • Acted for a leading foreign IT service provider for an IT outsourcing project that involved the provision of IT products (including hardware and software) and services to the IT subsidiary of an established local bank. The scope of work included the review, drafting and negotiations of the IT outsourcing agreement and other IT-related agreements.
  • Acted for an Indonesian bank in reviewing, drafting, advising and conducting negotiations in relation to a system licence and services agreement with a Labuan incorporated IT service provider. This complex transaction involved the (a) outsourcing of the bank’s data centre, disaster recovery facility and management services; (b) licence and implementation of a new system to process the bank’s daily banking transactions; and (c) provision of maintenance services of the licensed system; in Indonesia.
  • Acted for a prominent Islamic insurance operator in Malaysia in reviewing, drafting and advising in relation to an IT infrastructure operations management services agreement with a leading IT service provider. This transaction involved the outsourcing of the management of the insurance operator’s IT systems.
  • Acted for a leading international life insurance company in reviewing, drafting, advising and conducting negotiations in relation to a managed contact centre services agreement which involved outsourcing of call centre management services to a leading IT service provider in Malaysia.
  • Acted for a leading global IT service provider for an IT outsourcing project that involved the outsourcing of IT systems for a regional supermarket company. The scope of work included advice, review, drafting and negotiations of the IT outsourcing agreement.
  • Acted for a local IT service provider in viewing, drafting, advising and conducting negotiations in relation to a substantial outsourcing project with a local bank. The work undertaken had progressed to a very advanced stage although ultimately the project did not complete due to other reasons.

  • Advising on and drafting of contracts in intellectual property related areas e.g licensing, franchising, distributorships and contract manufacturing.
  • Advising on governmental regulations in relation to transfer of technology and drafting technology transfer contracts.
  • Advising on labelling and advertising claims covering various industries e.g. food, beverage, cosmetics, electrical and telecommunications products.
  • Advising on matters relating to the Consumer Protection Act 1999 and product liability issues.
  • Advising on privacy laws in Malaysia under the Personal Data Protection Act 2010.
  • She has also been involved in certain major projects in Malaysia, e.g. the Multimedia Super Corridor (MSC), whereby she acted for a number of foreign IT companies in contract negotiations with the Government of Malaysia in respect of the Multimedia Flagship applications.
