Overview

Loshini graduated from the Cardiff University in 2008 and was called to the English Bar (Inner Temple) in 2009. She obtained her Master of Laws from the University of Manchester in 2010 in International Financial Law. Upon returning to Malaysia, she commenced her pupillage in the Construction and Engineering practice group at Skrine and was admitted as an Advocate and Solicitor of the High Court of Malaya in 2011. She is now a Senior Associate with Skrine.

Her portfolio of litigation work includes arbitration, construction and engineering contracts, corporate and commercial disputes, and oil and gas.

She is presently a Committee Member of the Chartered Institute of Arbitrators (CIArb)(Malaysia Branch) and Honorary Treasurer of its Young Members Group (YMG).

Experience

Arbitration and Litigation

Experience in domestic arbitrations in Malaysia (including ad hoc), arbitration related applications before the Malaysian Courts and litigation concerning construction and engineering contracts:-

  • Acted as Co- Counsel in an ad-hoc arbitration against a government body concerning disputes arising from the construction of a solid waste treatment plant.
  • Acting as Co- Counsel in a KLRCA arbitration concerning claims arising from the idling of construction machineries.
  • Acting as Co-Counsel in a KLRCA arbitration concerning claims arising from construction of a cooling water pump house for a power station.
  • Acting as Co-Counsel in a KLRCA arbitration against the developer concerning disputes arising from the construction of a service apartment.
  • Acted as Co- Counsel for a contractor against a government body in the High Court and Court of Appeal in an application to refer questions of law arising out of the arbitral award pursuant to Section 42 of the Arbitration Act 2005.
  • Acted as Counsel for a subcontractor in the High Court in successfully resisting claims arising from a water reticulation project.
  • Acted as Co-Counsel against an oil and gas company concerning claims arising from damage to horizontal directional drilling (HDD) boreholes and access road.
  • Acting as Co-Counsel for a leading Malaysian oil and gas company against a foreign company concerning disputes arising from a project known as the “Supply, Delivery, Installation and Commissioning of Refurbished Wellhead Platform, Pipeline and Host Tie-Ins”.

Others

  • Advised a leading French chemical company in relation to the construction of its thiochemical platform in Malaysia.
  • Advised a leading oil and gas company in relation to the suspension of a licence to undertake upstream consulting work pursuant to an EPCIC Alliance for an LNG Regasification Facilities Project which involved the engineering, procurement, construction management, installation and supervision of the design and construction of a LNG Regasification Unit.
  • Providing on-going advice to the works contractor, a leading master builder and construction company in Malaysia, on the construction and completion of the works relating to the mass rapid transit project.
  • Providing on-going advice to the employer on the construction and completion of works relating to the development of a low cost terminal and associated works at Kuala Lumpur.
  • Acted as Co-Counsel for the architect in a Commission of Enquiry set up by the Chief Minister of Penang to enquire into the cause of collapse of the UMNO Tower.
  • Handled related documents under various contracting arrangements for construction and infrastructure projects.
  • Assisted in drafting dispute resolution clauses including arbitration, mediation and hybrid clauses for various types of contracts.
  • Assisted in advising on legal issues arising from standard forms of construction contract including bespoke contracts.
