Nicholas Lai graduated from the University of Reading, UK and completed the Bar Professional Training Course at Cardiff University, UK the following year where he qualified as a Barrister-at-law at the Honourable Society of Lincoln’s Inn.

Commencing his pupillage at Skrine, he was subsequently admitted to practice as an Advocate and Solicitor of the High Court of Malaya.

He is now a Senior Associate with Skrine in the Dispute Resolution Group.

Trade Remedies

  • Acted for multiple exporters and trade associations from a wide range of jurisdictions including Japan, China, Korea, Taiwan, Singapore, France, Finland, Brazil etc.
  • Experienced and well-equipped in handling anti-dumping and safeguard investigations, with notable successes. Collaborated with law firms from the various jurisdictions on anti-dumping / safeguard investigations.
  • Acting in the first ever judicial review case in the Malaysian Special Powers Court on a safeguard decision made by the Malaysian Investigation Authority.

Dispute Resolution

Selected experience in Dispute Resolution :-

  • Assisted in representing a foreign public university in a dispute with its former local corroborative partner regarding scope and effect of corroborative agreement, provisions of courses locally and enrolment & recruitment of students;
  • Assisted in representing foreign accountancy professional body in a defamation / contractual suit arising from the internal disciplinary procedures of the professional body;
  • Assisted in defending a High Court decision at the Court of Appeal on an award to impute liability of RM113 million against a holding company through the principle of “lifting the corporate veil”;
  • Assisted in a multimillion US Dollar contractual suit, involving multiple international corporations, for specific performance of a contract in the absence of a formal sale and purchase agreement;
  • Assisted in the recovery of debts arising from the breach of loan facility agreements on behalf of banks in various matters, both in the High Court and Court of Appeal;
  • Assisted in obtaining injunctive reliefs, amongst others, a freezing order (Mareva Injunction) on assets of a corporation where monies were believed to have been wrongly dissipated;
  • Assisted in representing globally-recognised professional body in obtaining injunctive reliefs of a mandatory order to remove postings on social media platforms which were defamatory to its professional integrity and reputation.

  • Assisted in drafting the Malaysian Chapter of Global Competition Review’s publication, Private Antitrust Litigation 2014 and Private Antitrust Litigation 2015.
