Sara Lau Der Yin graduated with an LL.B (Hons) in 2011 and was called to the Bar of England and Wales in 2012 upon completion of the Bar Professional Training Course and being a Barrister-at-Law of  Lincoln’s Inn. She then commenced her pupillage with Skrine in October 2012. She was admitted to practice as an Advocate and Solicitor of the High Court of Malaya on 1 November 2013.

She is now a Senior Associate with Skrine’s Dispute Resolution Division.

  • Advised and assisted a wide range of clients including multinational corporations that employ foreign employees in Malaysia or that second/assign such employees to Malaysia, in obtaining the relevant work permits for the employees, as well as dependant passes for such employees’ family members.
  • Advised and assisted in other immigration advisory work including on the employment of expatriates and foreign workers and on the issuance of various types of valid passes for long term stay in Malaysia.

Employment & Industrial Relations

  • Advised various corporations on contracts of employment, independent consultancy agreements, internship and volunteer work agreements, applicability of the Personal Data Protection Act to various employment contracts and secondment agreements.
  • Advised various corporations on all general HR practices including on misconduct, retrenchment and redundancy, employee performance management, employee investigations and disciplinary proceedings, mutual and voluntary separation schemes.
  • Represented (as junior counsel) companies at trials in the Industrial Court, trials, appeals and judicial reviews in the High Court, and appeals in the Court of Appeal level in various areas of employment law, including in respect of dismissal from employment, disputes arising from mutual separation agreements and agency agreements, and on contributions to statutory funds.
  • Advised corporations on all employment aspects of takeover of business, merger of business and in local incorporation.
  • Drafted and reviewed contracts of employment, independent consultancy agreements, agency agreements, nominee directorship agreements, internship and volunteer work agreements, and Personal Data Protection clauses for the same.

Shipping & Maritime

  • Assisted in advising in areas of shipping and maritime law including on definition of vessels, arrest of vessels, arrest of sister vessels, recovery of ship mortgage and trusts applicable to shipbuilding contracts.
  • Assisted in arresting vessels in Malaysian ports for maritime claims and for enforcement of mortgage.

Trade Relations

  • Advised and assisted companies in collective agreement disputes with in-house and national union of workers.
  • Acted as junior counsel in trade dispute cases in the Industrial Court.

Pro Bono

  • Provide legal advice on applicability of Immigration law to foreign volunteers
  • Assisted in representing stateless individuals to obtain citizenship
  • Acted as counsel for criminal breaches of immigration laws

General Civil Litigation

  • Assisted and advised on various areas of civil and commercial laws, including defamation, breach of contract, tort and arbitration.
