Overview

Sara Lau Der Yin graduated from the University of Reading in 2011 and completed her Bar Professional Training Course in City Law School, City University London in 2012. She then commenced pupillage at Skrine and was admitted to practice as an Advocate and Solicitor of the High Court of Malaysia in November 2013. She is now a Senior Associate with Skrine in the Dispute Resolution Group.

Sara’s main areas of expertise is in Employment and Industrial Relations and she regularly performs both litigation and corporate employment work. She has experience in all levels of courts in Malaysia, including the Industrial Court, High Court, Court of Appeal and Federal Court. Besides Employment and Industrial Relations, she is also very experienced in immigration employment work, including the employment of expatriates and foreign workers in Malaysia.

Her other areas of practice include shipping and maritime, civil and commercial law and medical negligence.

Employment & Industrial Relations

Litigation:

  • Assisted and acted for an MNC in the insurance industry on the termination of agency agreements wherein the agents alleged themselves to be employees of the MNC.
  • Assisted and acted for a statutory body in a judicial review pertaining to the implementation and execution of public salary schemes.
  • Assisted and acted for a statutory body in a judicial review pertaining to the dismissal of an employee for divulging secret data to third parties for personal gain.
  • Independently advised, assisted and acted for a statutory body in a judicial review pertaining to the dismissal of an employee for fraudulent conduct.
  • Independently advised, assisted and represented a Port in Malaysia in relation to the dismissal of an employee of misconduct.
  • Assisted and acted for an expatriate employee who was denied remuneration payments in breach of a termination agreement.
  • Assisted and acted for a large advertising company in relation to the dismissal of a high-ranking employee during probation.
  • Assisted and acted for a MNC in a judicial review of the Minister of Human Resources’ decision to refer an unfair dismissal claim to the Industrial Court for adjudication.

Corporate Employment & Advisory:

  • Drafting, Reviewing, Revising Contracts of Employment, Employment Handbooks, Employment Policies, Data & Privacy Policies, Collective Agreements, Show Cause Letters, Warning Letters, Dismissal from Employment Letters, Redundancy Letters etc.
  • Provided immediate practical written and verbal advice and management strategies to corporations and companies involving summary termination, medical boarding out, poor performance, retrenchment, mutual separation agreements, compliance with labour law and practice.
  • Advised a large pharmaceutical company on the legal implications of engagement of and status independent contractors.
  • Advised an airport management company on the restructuring of its employment organisation due to a redundancy.
  • Advised, assisted and provided support in relation to employees and employment law concerns in transfer of business and share acquisition including in relation to preparing due diligence reports.

Immigration

  • Advised and assisted a wide range of clients including multinational corporations that employ foreign employees in Malaysia or that second/assign such employees to Malaysia, in obtaining the relevant work permits for the employees, as well as dependant passes for such employees’ family members.
  • Advised and assisted in other immigration advisory work including on the employment of expatriates and foreign workers and on the issuance of various types of valid passes for long term stay in Malaysia.

Shipping & Maritime

  • Assisted in advising in areas of shipping and maritime law including on definition of vessels, arrest of vessels, arrest of sister vessels, recovery of ship mortgage and trusts applicable to shipbuilding contracts.
  • Assisted in arresting vessels in Malaysian ports for maritime claims and for enforcement of mortgage.
  • Advised a foreign multi-national bank on the arrest of a Vessel due to failure to make mortgage payments, including handling and managing the arrest of the Vessel, her crew and her subsequent sale process.
  • Advised a foreign multi-national bank on the issue of abandonment of vessel by her crew.

Trade Relations

  • Advised and assisted companies in collective agreement disputes with in-house and national union of workers.
  • Acted as junior counsel in trade dispute cases in the Industrial Court.

Pro Bono

  • Provide legal advice on applicability of Immigration law to foreign volunteers
  • Assisted in representing stateless individuals to obtain citizenship
  • Acted as counsel for criminal breaches of immigration laws

General Civil Litigation and Commercial Litigation

  • Assisted and acted for a Member of Parliament in a defamation matter involving a defamatory article published in a renowned local newspaper
  • Assisted and acted for a GLC in relation to breach of contract in delivery of rice
  • Independently managed and handled a trial matter pertaining to the existence of a contract for services
  • Assisted and acted for a corporation seeking to set aside an Arbitration Award
  • Assisted and advised clients in relation to debt recovery
  • Assisted and acted for a company in relation to a pre-action discovery application
