Witter Yee graduated from the National University of Malaysia with LLB (Hons) degree in 2011 and was admitted to practice as an Advocate and Solicitor of the High Court of Malaya on May 2012. Witter joined Skrine as an Associate in the Dispute Resolution Division in May 2013 after a short stint working with a reputable law firm in Kuala Lumpur.

Dispute Resolution

  • Assisted in arbitration under the UNCITRAL rules, involving a dispute between a notable local port operator and an international oil and gas company arising out of a fire incident. The value of claims amount to USD25 million. Seat: Kuala Lumpur
  • Assisted in arbitration under the PAM Arbitration Rules, arising out of the sub-contractor’s failures to perform its contractual obligations. Seat: Kuala Lumpur.
  • Assisted a local franchise bakery chain in defending a suit brought by its contractor for payments due and payable under contract.
  • Assisted in defending a claim against a Government Linked Company brought by its main contractor in respect of recovery for payments due and payable.
  • Assisted in defending a British multinational life insurance and financial services company against a suit brought by the nominee under the insurance policy for the policy monies.
  • Assisted a local company in the recovery of arrears of rents.
  • Appeared as co-counsel for local newspapers in various defamation actions.
  • Appeared as co-counsel for insurers to defend negligence suits against lawyers.
  • Appeared as co-counsel for a multinational property developer in a judicial review against land acquisition by the local authority where the High Court set aside the land acquisition on the sole ground of mala fide.
  • Appeared as co-counsel for a reputable property developer in a dispute between the developer and its purchasers.
  • Appeared as co-counsel in various eviction cases involving squatters.
  • Assisted partners in hearings and trials in lower and apex court.

Advisory

  • Advised a local “common-user multi- purpose liquid bulk terminal operator” on its claim against a renowned local vegetable oil manufacturer for outstanding fees for storage services rendered.
  • Assisted in advising a local port operator on the “Most Favoured Nation Clause” under the Terminal Agreement entered between them and one of the largest international containers shipping company.
  • Assisted in advising a local port operator on its dispute between its contractors with regards to the supply of cranes.
  • Advised a local real estate agency on the effect of its failure to register as a registered real estate agency under the Valuers, Appraisers & Estate Agents Act 1981.
  • Advised a local advertising company on its liability under the Public Liability Insurance towards a local train operator.
  • Assisted in advising a local financial institution on possible cause of action available against its employee for facilities negligently granted to a company.
  • Advised Japanese Insurance Company on Product Liability Law in Malaysia.
  • Advised an international financial institution on the application of warehouseman lien under Malaysian law.
  • Advised a multinational manufacturer of building material on issues of land encroachments.
