Vijay graduated from the University of London with a second class upper degree. He was called to the Malaysian Bar in 2001. He was made partner in 2011.

Vijay is experienced in handling all aspects of litigation and has appeared at all levels of the Malaysian courts. He is also experienced in resolving disputes through arbitration. He has a broad practice and is particularly experienced in commercial disputes, judicial reviews, land acquisitions, rating appeals, defamation and other torts.

Commercial Disputes

  • Acted for prominent local and international banks in various legal proceedings including relating to pledges of shares, alleged internet banking fraud, and fraud in relation to an estate bank account.
  • Acted against the Government of Malaysia in an arbitration relating to two contracts to computerise certain systems where the total claim exceeded RM62 million (ultimately settled).
  • Acted in legal proceedings for the water supply company which serves the state of Selangor, KL and Putrajaya.
  • Acted for a main contractor (who was appointed to design and build a gas and steam turbine power plant) in resisting a claim premised upon 2 bills of lading in respect of late delivery of shipping containers used to deliver raw material to the site.
  • Acted for a prominent insurance company in legal proceedings involving cheque fraud.
  • Acted in legal proceedings for a technology company (which provides retail solutions aboard flights) against a long-haul airline.
  • Acted for a large purified terephthalic acid (PTA) producer in a litigation (completed) and presently acting for them in an arbitration (pending).
  • Acted for DBKL (KL City Hall) in proceedings relating to its termination of Klang Bus Stand’s lease.

Company/Corporate Disputes

  • Acted for and against minorities in company oppression petitions.
  • Acted for one of the sides to a joint venture (involving a contemplated water privatisation project for one of the States within Malaysia) in defending a claim for breach of the joint venture and breaches of fiduciary duties.
  • Advised a prominent local telecommunications company and its ultimate parent company about breaches of fiduciary duties by its employee and officer.

Insolvency & Receivership

  • Acted for a local national asset management company in various proceedings relating to recovery of debts.
  • Acted in legal proceedings for receivers & managers/companies in receivership, and liquidator.
  • Involved in a series of litigation and appeals on behalf of a prominent public listed company for the purpose recovering monies owing to them and defending them in a counter suit where the amounts at stake exceeded RM100 million, and where the proceedings and appeals therefrom spanned from West to East Malaysia, including instructing East Malaysian solicitors and counsel on behalf of client.

Public and Administrative Law

  • Acting for the leading gas infrastructure and utilities company within the country, which is also one of the largest companies on the local bourse (in terms of market capitalisation), in a Judicial Review against one of the city councils in Malaysia (pending).
  • Acting for one of the State Governments in Malaysia in a civil suit relating to one of the largest if not largest projects in the Malaysia (pending).
  • Acted for the largest electric utility company in Malaysia and possibly the largest power company in Southeast Asia in Judicial Reviews and in other legal proceedings.
  • Acted for billboard companies in Judicial Reviews against local authorities in respect of refusals to grant licenses and permits for billboards.

Land Acquisition

  • Acting for the national oil company in acquisitions where the total value of claim which is being resisted is in excess of RM 500 million (pending).
  • Acted for a large land holding company where the market value of the lands were, in total, put forward as being in excess of 130 million and of which a substantial amount was received through settlement.
  • Acting for a large palm oil plantation company where the value of claim is in excess RM75 million (pending).

Rating Appeals

  • Acted for the leading gas infrastructure and utilities company within the country, which is also one of the largest companies on the local bourse (in terms of market capitalisation), in appeals against the imposition of rates by various local authorities around the country.


  • Acted for and advised various local newspapers in defamation suits.
  • Represented a member the royal family of one of Malaysia's thirteen states against a local newspaper.
  • Acted on behalf of a prominent local food and beverage company and a prominent local gaming company for internet defamation involving urgent applications for injunctive relief.
  • Successfully argued at the High Court a new proposition for defamation laws in Malaysia, namely that an action for defamation may be summarily struck out if the cost and effort in bringing the action would be disproportionate to the damage to reputation.

Other Torts

  • Acted for firms of solicitors (pursuant to appointment by insurers) in defending suits and claims premised on professional negligence.
  • Advised employers in respect of breaches of confidence by its employees/ex-employees and acted in legal proceedings for employer.
  • Acted against one of the State Governments (successfully) in a claim based on trespass and sand theft.
  • Acted for a large billboard company against a prominent highway concessionaire and another large billboard company for trespass.


  • Acted/acting for a prominent insurance company in a number of legal proceedings by policyholders (including group actions).
  • Acted for and advised a local gaming company and/or its subsidiaries in various legal proceedings/matters.
  • Acted in legal proceedings for a company responsible for the management and programming in a radio station of a prominent local media broadcasting company.
  • Acted for a prominent local telecommunications company in relation to a claim for breach of copyright.
  • Acted for a prominent German car manufacturer in legal proceedings relating to alleged defects in their car.
  • Acted for a prominent valuation company in a claim for breach of an oral estate agency in respect of the sale of lands on which the Lynas Advanced Materials Plant (LAMP) was later built.
  • Represented a rubber products producer in charges brought against them under the Environmental Quality Act 1974
